Terms of Services

A. Terms of Use

  1. 3 ELEMENTS COURIER AGGREGATOR PRIVATE LIMITED, a private limited company incorporated under the Companies Act 2013, having corporate identification number U64120KA2020PTC132127 and having its registered office at 114 Tranquil Ambiance 157/128-1, Vignan Nagar, Bangalore -560075 (hereinafter referred to as “the Company”) owns and operates an online technology platform (Marketplace) branded as ‘Coreyo’ accessible through web www.coreyo.com or mobile application (hereinafter referred to as “Coreyo” or “We”) for the courier and cargo industry. Subject to the presents here, Company may allow Courier Partners (defined below) to use Coreyo, on “as-is-basis” to list and display their services (“Services”) and other data on Coreyo.

  2. For the purpose of these Terms of Use, wherever the context so requires “You”, “Your” or “User” shall mean any natural or legal person who has agreed to become a User on Coreyo by providing Account registration data, while registering on Coreyo as registered User using the computer systems. Coreyo allows the User to surf Coreyo without registering on Coreyo. The term “We”, “Us”, “Our” shall mean and refer to Company its employees, and authorised agents that perform any services on the Company’s behalf.

  3. Your use of the Coreyo and/or the Services being offered therein of the respective courier service providers (“Courier Partner(s)”) are governed by these terms and conditions (“Terms of Use”) along with the conditions specified by the respective Courier Partners which are incorporated herein by way of reference. If You transact on Coreyo, You shall be subject to the such policies. By mere use of Coreyo, You shall be contracting with Us and these terms and conditions including the policies constitute Your binding obligations, with Us.

  4. When You use any of the Services provided by Courier Partners, You may also be subject to the rules, guidelines, policies, terms, and conditions applicable to such Services of the Courier Partner (hereinafter “CP Policies”), and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use or the CP Policies may be changed by Courier Partners at any time without any prior written notice to You.

    It is Your responsibility to review these Terms of Use and CP Policies periodically for updates / changes. Your continued use of Coreyo following the posting of changes will mean that You accept and agree to the revisions of the Terms of Use and CP Policies. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use Coreyo. Your use of Coreyo will be subject to the most recent version of the Terms available on our website. We recommend that you read through the Terms available on the website regularly so that you can be sure that you are aware of any changes that may apply to you.

  5. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Coreyo Policies (including but not limited to Privacy Policy) as amended from time to time and the Applicable Laws. The term “Applicable Law” shall mean any statute, law, regulation, ordinance, rule, judgment, notification, rule of common law, order, decree, bye-law, government approval, directive, guideline, requirement or other governmental restriction, or any similar form of decision of, or determination by, or any interpretation, policy or administration, having the force of law of any of the foregoing, by any authority having jurisdiction over the matter in question, whether in effect as of the date of these Terms of Use or thereafter.

B. User Eligibility

  1. Transaction on Coreyo is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use Coreyo. If You are a minor i.e. under the age of 18 years, You may use Coreyo or access Coreyo only under the supervision and prior consent/ permission of a parent or legal guardian.

  2. We reserve the right to terminate Your account and / or refuse to provide You with access to Coreyo if it is brought to Our notice or if it is discovered that You are under the age of 18 years and transacting on Coreyo.

C. Account Creation

  1. In order to create an account on Coreyo, You are required to sign up for an account by providing Your accurate information and select a password and username (“Account”). Thereafter, in order to authenticate the Account, You are required to provide Your registered mobile phone number and/or e-mail address, which shall be verified and validated by one time verification password (“OTP”). You promise to provide Us with accurate, complete, and updated registration information about yourself.
  2. Your mobile phone number and/or e-mail address is treated as Your primary identifier on Coreyo. It is Your responsibility to ensure that Your mobile phone number and Your email address is up to date on Coreyo at all times. You agree to notify Us promptly if Your mobile phone number or e-mail address changes by updating the same on Coreyo through an OTP.
  3. By creating an Account on Coreyo, You agree that the Coreyo may send You informational text (SMS)/ WhatsApp messages / email(s) or connect You through voice call as part of the normal business operation of Your use of the Services. You may opt- out of receiving text (SMS)/ WhatsApp messages / email(s) or from receiving voice calls from Coreyo at any time by unsubscribing from the service at www.coreyo.com/services indicating that You no longer wish to receive any messages or voice calls, along with the phone number of the mobile device receiving the messages or calls. You acknowledge that opting out of receiving any messages or voice calls may impact Your use of the Services. The User hereby unconditionally consents that such communications via SMS, WhatsApp messages, voice call, email or any other mode by the Company are:
    1. upon the request and authorization of the User;
    2. ‘/Transactional’ and not an unsolicited commercial communication’ as per the guidelines of Telecom Regulation Authority of India (“TRAI”), and
    3. in compliance with the relevant guidelines of TRAI or such other authority in India and abroad.

    The User will indemnify the Company against all types of losses and damages incurred by the Company due to any action taken by TRAI, access providers (as per TRAI regulations) or any other authority due to any erroneous complaint raised by the User on the Company with respect to the communications mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

  4. Your Account and Registration Obligations: If You use Coreyo, You shall be responsible for maintaining the confidentiality of Your display name and password and You shall be responsible for all activities that occur under Your display name and password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the Terms of Use or may cause any legal liability to Us, We shall have the right to indefinitely suspend or terminate or block access of Your account and refuse to provide You with access to Coreyo without notice and without any liability..
    1. You agree that We shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under Your Account in cases, including, where You have failed to update Your revised mobile phone number and/or e-mail address on Coreyo.
    2. Users are advised to check the description of the Services carefully before making a Booking (defined below). User(s) agree to be bound by all the conditions as contained in Booking confirmation or as laid out in the confirmed Booking voucher. These conditions are also to be read in consonance with the ‘Terms of Use’.
    3. You will not share Your account or password with anyone, and You must protect the security of Your account and Your password. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.
    4. You are responsible for all activity and content (data, graphics, photos, links) that is uploaded under Your Account.

D. Business Users

In addition to the registration and creation process for Account (as provided above), Business Users are required to register themselves by providing the following details:

  1. Business name (as per GST Certificate)
  2. Business type (Private Limited Company, Public Limited Company, Partnership, Proprietorship & others)
  3. GSTIN

E. Courier Services Workflow

  1. Coreyo is an online technology platform/ marketplace for the courier and cargo logistics sector accessible to customers through web (www.coreyo.com) or via a mobile application. The following workflow reflects the manner by which You could access the courier Services on the Coreyo platform.
    1. Coreyo lists only dependable and accredited Courier or Logistics Partner on the Coreyo Platform. Each Courier Partner are required to interalia sign a Master Listing Agreement and Coreyo Terms of Access (CTA) and/or such similar agreements as mutually agreed between Coreyo and its Logistics Partner . The CTA also provides for certain minimum service standards which the Courier Partner should abide by which are intended to protect the interests of the User.
    2. User shall make the booking (“Booking”) of shipment by selecting desired courier Services (based on multiple rating criteria of the Courier Partner) on the web (www.coreyo.com) or via a mobile application.
    3. The Booking shall be forwarded by Coreyo to the Courier Partner, which shall be subject to confirmation from the Courier Partner. It shall be the sole discretion of Coreyo and/or the Courier Partner whether to confirm such booking or not.
    4. Post receipt of confirmation form the selected Courier Partner, Coreyo shall share the automated tracking number and other requisite details to the User.
    5. Selected Courier Partner (or a hyperlocal delivery partner) shall pick up shipments from the Users location as communicated to Coreyo at the time of Booking through the Coreyo™ platform.
    6. The User shall review any mail or message of the Courier Partner and Users should keep the goods to be shipped ready in a tamper proof and damage proof packing or in the manner as communicated by Courier Partner. In case of any clarifications, it will be the responsibility of the User to coordinate with the selected Courier Partner with regard to the courier Services availed of the Courier Partner. The Courier Partner at its sole discretion may deny the service if proper packing according to their requirement is not made by the User. Notwithstanding anything contained anywhere in this document: (a) if external packing is damaged for whatever reason and the content is intact, then neither the courier partner nor Coreyo shall have any liability whatsoever (b)If packing is damaged/tampered and/or address is not clear/the address slip damaged and consequently the courier becomes undeliverable, unidentifiable or lost, then, neither the courier partner nor Coreyo shall have any liability whatsoever.
      (i) Coreyo order number;
      (ii) Addressee/consignee details and address;
      (iii) Description of the product being shipped;
      (iv) Return address
      (v) the Gross Value
      (vi) Collectable Value (Net value) to be collected in case of COD (Cash on Delivery) shipments.
      Coreyo™ dashboard allows users to take a print of the shipping label with all the details noted above and the same shall be pasted on the package before the handover to the Courier Partner. The user shall make sure that the address label is sufficiently laminated and adequately stuck on to the packing to ensure that accidental water spillage or ordinary logistical process will not tamper it. Neither Coreyo nor the Courier Partner shall be liable for any such issues related to the address label.
    7. User shall be ready with the packed order when the Courier Partner comes to receive the shipment. All pick-ups should be logged before the cut off time provided by Courier Partner and no pickup beyond the cut-off time of the Courier Partner shall be possible. Even though pick-ups will be automatically initiated through Coreyo dashboard, User agrees that they shall contact the Courier Partner personnel for the coordinating the pickup of their shipments
    8. User shall agree that the Service is only for single pick-up location i.e. the orders will be picked by the Courier Partner from only the location specified at the stage of the Booking.
    9. User shall collect receipt(s) of the signed copy of the shipping manifest; it is the proof of handover of shipment to the Courier Partner. Coreyo through its Courier Partners shall provide web-based (online) tracking solutions for all shipments.
    10. In case of any transaction failure or service outage, We would in terms of the Coreyo Terms of Access and the Master Listing Agreement may take appropriate remedial action to protect consumer interests. The user hereby agrees that Coreyo shall have the sole and exclusive privilege to decide what remedial action to take. Coreyo shall not be held liable by the user for any such remedial actions taken by Coreyo in the best interest of the user.
    11. The Courier Partners are independent from Coreyo and are not agents or employees of Coreyo. Coreyo is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any Courier Partner, including damages or expenses resulting therefrom.
    12. If a courier/shipment is lost, any claim of loss shall be raised by the user to the Courier Partner through Coreyo at the time of delivery after which the user hereby waves any right to make a claim of loss against the lost courier/shipment. For lost and undelivered shipments, such grievance shall be submitted in writing within 48 hours of the estimated delivery date.
    13. Shipping policy/delivery: Coreyo had identified a panel of service providers who are capable to provide efficient services all across the country within 1-7 days.

F. Access to Coreyo

  1. We will do our utmost to ensure that availability of Coreyo will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, Your access to Coreyo may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit but cannot guarantee the frequency and duration of any such suspension or restriction.
  2. As part of Coreyo, You may from time to time receive updates/upgrades to our platform from Us, which may be automatically downloaded and installed to Your device/systems or reflected on our website. These updates may include bug fixes, feature enhancements or improvements, or entirely new versions of Coreyo and/or Services offered therein. You agree that We may automatically deliver such updates to You as part of Coreyo and/or Services offered, and You shall receive and install them as required for continuous services or usage of Coreyo.
  3. When You use Coreyo or send emails or other data, information or communication to Us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Coreyo periodically and as and when required. We may communicate with You by email or by such other mode of communication, electronic or otherwise. Medium of communication: The medium of communication on Coreyo shall be in English.
  4. Said to Contain Basis: It is expressly understood by and between the parties that all shipments agreed to be delivered by the Courier Partner are on “SAID TO CONTAIN BASIS” i.e. the Courier Partner shall be under no obligation and is not expected to verify the description and contents of the shipments declared by the User on the docket and as such, the User shall undertake and ensure to make a proper, true, fair, correct and factual declaration on the docket regarding description and value of shipments. Further, We are not responsible in any way whatsoever for the merchantability of the shipment and appropriateness of the Courier Partner to handle the shipment. You hereby agree that you shall be solely and exclusively responsible for the contents of your shipment.
  5. Inspection: Notwithstanding anything contained in this Terms of Use, the Courier Partner has the right, however, not an obligation, to inspect any shipment consigned by the User to ensure that all the items are capable of carriage to the destination as per CP Policies. At no point in time does the Courier Partner warrant that any particular shipment to be delivered is capable of carriage without infringing the law of any state of the country from/ to or through which the shipment may be carried. The Courier Partner reserves the right to refuse to deliver the shipments that do not conform to these terms and conditions and CP Policies without assigning any reasons whatsoever.
  6. The User will be solely responsible to comply with all statutory requirements (State and Central Laws/Statutes) applicable in relation to booking, sale and transportation of the shipments carried and delivered by the Courier Partners of Coreyo™ in pursuance of this Terms of Use.

G. Consideration / Charges

  1. User agrees to pay to the Courier Partner through the Coreyo Wallet/ bank authorisation or payment gateway, the applicable shipping charges in prepaid manner as set out in Rate Calculator section in Coreyo dashboard. In addition, Courier Partner and the Company reserves the right to apply additional charges as per clause 6.3 below and other applicable charges over and above the shipping base rates. Courier Partner service charge like COD charges and other fees are as on the live calculator link in user’s admin panel. As per standard Courier Partner norms, You will be charged a minimum of 0.5 kgs (or in multiples) for Your air shipping. Please note that the weight charges applied by the courier companies may differ but however such charges shall be adjusted in Your Coreyo account.
  2. The Company shall issue an invoice which will get auto adjusted against the User credit lying in the Coreyo Wallet/ bank authorisation or payment gateway as the following conditions:
    1. If the Invoice amount is less than the credit in Your wallet, User agrees that the freight invoice amount will be automatically adjusted from the Users Coreyo Wallet and shall be marked as paid. The User shall then continue using Coreyo Services from the remaining credit amount.
    2. If the invoice amount is more than the credit in Your Coreyo wallet, then User agrees that he would recharge the Users Coreyo Wallet.
  3. ADDITIONAL CHARGES: In connection with Your use of Coreyo, You would be liable to pay additional charges consequent to the change in weight, contents, location, additional services provided by Courier Partners, insurance, etc. Please note that Courier Partners can charge additional fees in the following circumstances-
    1. Change in Weight: Bookings are made and charges are levied on the basis of weight. In case of wrong slab/weight categorisation, You will be charged additional fees or levies by the Courier Partner based on the weight of the courier package. Freight is calculated on the basis of volumetric weight or actual weight whichever is higher. Dead/Dry weight or volumetric weight whichever is higher should be taken while calculating the rates. In case declared weight differs and is less than actual weight shipping charges will be revised to actual weight. Volumetric weight is calculated as (length × width × height) / (dimensional factor). Dimensional factor varies from 2700 to 5000 cm3/kg as stated by respective Courier Partner.
    2. Change in Shipment Description: You shall clarify any doubts/concerns with respect to usage of the Coreyo and check the description of the Services carefully before making a Booking. In case Bookings are made with wrong description or mode of transport, We will not be liable to reimburse any additional amount deducted.
    3. Pickup and Delivery Zones: Zones are pre-defined as per the source pin code for each Coreyo account, charges will be applicable on this definition. You are requested to check the zoning matrix before placing any order. We shall not be liable for any discrepancy arising due to this.
    4. Insurance: You will be levied additional charges towards insurance through accredited Insurance companies in case You opt to insure the shipments from point of origin to point of final destination. In case of damages or losses to the shipments, the Courier Partner shall, at Your request provide the certificate of facts (COF) to enable You to claim insurance for such damaged/lost shipment. The time taken by Coreyo in issuing the certificate of facts (COF), however depends on the time a Courier Partner takes in providing the same to Coreyo. The format and content of the certificate of facts (COF) depends on the content and format in which a Courier Partner provides it to Coreyo.
    5. International Packages: Shipments which cross national borders/ international shipments may be subject to customs clearance, in India and/or the destination country prior to delivery to the addressee. The User is responsible for making sure goods shipped are acceptable for entry into the destination country. All charges for shipment to and return from countries where entry is not permitted shall be the User’s sole responsibility.
    6. Duties/Taxes: The user on its behalf shall keep Us indemnified against all duties, taxes, octroi, cess, clearance charges and any other charge/levy by whatsoever name called, levied on shipments. In event of such charges being levied by any government authority, the same can be claimed from the user against the challan /respite of the same. User shall keep Us indemnified against any loss, damage, costs, expenses arising out of any action or proceedings initiated by any authority (judicial or regulatory of the like) on account of any act/omissions on its part.
    7. Return to Origin: In case the delivery fails since the consignment was not accepted by the Consignee or due to incorrect address, failed delivery or any other reason whatsoever, at the location(s) as specified by the User. Courier Partner reserves the right to apply the RTO (return to origin) charges as per the agreed shipping rates
    8. Change in Shipment Description: You shall clarify any doubts/concerns with respect to usage of the Coreyo and check the description of the Services carefully before making a Booking. In case Bookings are made with wrong description or mode of transport, We will not be liable to reimburse any additional amount deducted.
    9. Odd Dimension: On shipments with either peculiar measurement or uncommon sizes extra charges apply since such shipments cannot be easily picked and shipped to the consignor.
    10. Priority shipments: The Courier Partner may levy additional charges with respect to priority deliveries, new services, conveniences and facilities. Levy of fees or modification to any existing fees is effective immediately upon availing such Services. The additional Services listed on Coreyo is only indicative and by no means exhaustive and the levy and pricing for the same would vary between Courier Partner to Courier Partner. We will not be liable to reimburse any additional amount deducted by the Courier Partner.
  4. Offers: From time to time, We may provide offers that entitle You to certain benefits. Each such offer has its own terms and conditions, which may be set forth on such offers and published on Coreyo or communicated to You separately.
  5. Promotional Codes:We may, in Our sole discretion, create promotional codes that may be redeemed for wallet credit, or other features or benefits related to the Services, subject to any additional terms that We establish on a per promotional code basis (“Promo Codes”). You agree that Promo Codes: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by Us; (iii) may be disabled by Us at any time for any reason without liability to Us; (iv) may only be used pursuant to the specific terms that We establishes for such Promo Code; (v) are not valid for cash; and (vi) may expire prior to Your use. We reserve the right to withhold or deduct credits or other features or benefits obtained through the use of Promo Codes by You or any other user in the event that the Company determines or believes that the use or redemption of the Promo Code was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or was not in accordance with this Terms of use.
  6. Account restrictions & Legal Action:We may at our sole discretion suspend, block, restrict, cancel the Account of such User and/or disqualify that User and any related Users who, files an invalid and/or false claims or provides false, incomplete, or misleading information. We reserve our right to initiate civil and/or criminal proceedings against such Users. In addition to the legal proceedings as aforesaid, We reserve the right to seek prosecution of any person who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.
  7. We reserve the right to charge service fees for aggregator services for Courier Partners and change Our policies from time to time. We reserve the right, without notice to You, to introduce new services and/or modify existing Services along with fees. Introduction of fees or modification to any existing fees is effective immediately upon implementation /publication on Coreyo. You agree that Your usage of Coreyo is supported by adequate consideration, the receipt and adequacy of which are hereby confirmed and acknowledged by You. Without limiting the foregoing, You acknowledge that such consideration includes, without limitation, the receipt or use of price comparison data, content and Services of Courier Partners, our review of Courier Partners, use or display of ratings, and the possibility of publicity and promotion from our review, use or display of content generated on Coreyo.

H. Modes of Payment

  1. Wallet: All Users get access to retain funds in Coreyo’s closed wallet payment system. You can deposit money in advance in Your wallet and can use the money in Your wallet as payment option along with other payment options available on Coreyo. Your use of Your wallet is subject to the following:
    1. You can credit money to Your wallet through Payment Gateway integrated with Coreyo.
    2. You can use the credited money to Your wallet against Services being offered on Coreyo only.
    3. In the event of successful cancellation of any Services, We will credit the amount in your wallet within 7days, after deducting remitted taxes and any service charge or cancellation fee imposed by the bank and/or Courier Partner, as applicable.
    4. In case of any failed transaction, Our systems will identify such failures and credit the amount to Your wallet only if the Company has actually received any amount.
    5. There is no scope of withdrawing balance in the wallet, and You cannot use monies in wallet for making payments to any third party service providers or for money transfer.
    6. In order to secure the wallet money, We have enabled an OTP based authentication for using the money in Your wallet.
    7. Any cash back or cash incentive offered by Us, will reflect in Your wallet.
  2. All payments made against the Services on Coreyo by You shall be compulsorily in Indian Rupees acceptable in the Republic of India. We will not facilitate transaction with respect to any other form of currency with respect to the transactions made on Coreyo. Further:
    1. Transactions, transaction price and all commercial terms such as Pickup, Delivery and/or Services are as per principal to principal bipartite contractual obligations between User and Courier Partner and the payment facility is merely used by the User to facilitate the completion of the transaction. Use of the payment facility shall not render Us liable or responsible for the non-delivery, non-performance, non-payment, damage, breach of representations and warranties, as regards the Services provided by the Courier Partner.
    2. You understand, accept and agree that the payment facility provided by Us is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, for the transactions on the Coreyo platform using the existing authorized banking infrastructure and Credit Card payment gateway networks. Further, by providing Payment Facility, We are neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price.
  3. Payment Facility for Users:
    1. You, as a User, understand that upon initiating a transaction, You are entering into a legally binding and enforceable contract with the Courier Partner to avail Services from the Courier Partner using the payment facility provided by Us, and You shall pay the transaction Price through Your issuing bank to Us by using Payment Facility.
    2. We reserve the right to refuse to process transactions by Users with a prior history of questionable charges including without limitation breach of any policies or this Terms of Use by User with Us or breach/violation of any law or any charges imposed by issuing bank or breach of any policy
    3. The User and Courier Partner acknowledge that We will not be liable for any damages, interests or claims etc. resulting from not processing a transaction/transaction price or any delay in processing a transaction/transaction price which is beyond Our control.
    4. While availing any of the payment method/s available on the Coreyo, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
      1. Lack of authorization for any transaction/s, or
      2. Exceeding the present limit mutually agreed by You and between “Bank/s”, or
      3. Any payment issues arising out of the transaction, or
      4. Decline of transaction for any other reason/s.
  4. Payment Gateway:
    1. All valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the User and the respective issuing bank and payment instrument issuing company.
    2. All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective issuing bank which support Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between User and the respective issuing bank.

I. Cash on Delivery (COD) Shipments

  1. Coreyo undertakes COD (Cash on Delivery) on the basis of Service orders through designated Courier Partners.
  2. In case of shipments booked under COD basis, Coreyo’s Courier Partner shall collect cash, as per the instructions of the consignee mentioned on the COD Order and remit/reimburse the amount to the Coreyo specified account to the account of the User.
  3. When the COD transaction is completed, We would update the Coreyo dashboard to include payments which has been received by Coreyo from the Courier Partner.
  4. COD payments received in the designated Coreyo account will be remitted to the Users bank account as per the Service order or upon the remittance instructions of the User or upon the User placing a withdrawal request for the same. The remittance will be made only and for which a withdrawal request has been placed.
  5. We shall be, in no manner liable to remit the COD (Cash on Delivery) that is to be received as payment by the User in case of forcible snatching of the delivery package. Such incidents/cases shall be the sole responsibility of the User and the User is liable to initiate actions to resolve such incidents, if any, on its own, including but not limited to legal processes
  6. COD services may be withdrawn or suspended any time without any notice by Coreyo with or without assigning any reason whatsoever.
  7. Return or RTO of Products:
    1. User hereby agrees that the returns will be initiated by the Courier Partners for all products which are not accepted by the Consignee due to failure of COD or any other reason whatsoever, at the location(s) as specified by the User. We reserve the right to apply the RTO (return to origin) charges same as the agreed shipping rates.
    2. In case of RTO, the User shall ensure that such products are accepted at the location(s) specified by the User at the time of booking. In case of non-acceptance of the RTO shipment by the User, Coreyo reserves the right to levy suitable demurrage charges for extended storage of such products for any period exceeding 7 (seven) calendar days from initiation of the Return and up to 45 (forty-five) days from such date. In case of non-acceptance of the products beyond 45 (forty-five) days, the Company has the right to dispose such products and the User will forfeit all claims in this regard.
  8. The User undertakes to resolve the disputes raised, if any, by the concerned Courier Partner within a period of 24 hours from the raising of such dispute(s). Failure to do so shall enable/authorise Us to hold the COD remittance, till the time such dispute(s) is rectified by the User.

J. Refund / Cancellation Policy

  1. Cancellation:
    1. Customers are not entitled to cancel their order once the Courier Service Partner has confirmed pick up for the order. In such cases, Coreyo will levy a penalty to an amount equal to the order value, with a right either not to refund the courier charges or to recover from a subsequent order.
    2. Coreyo has the sole rights to cancel orders:
      1. If the pickup location is in a non serviceable area
      2. If the pick up address does not match with the address mentioned in the original order
      3. If customer’s request for reschedule of pick up exceeds 2 times
      4. If courier service partners refuse to pick up in the mentioned location
  1. Refund:
    1. Customers will be entitled for Refunds under the following circumstances:
      1. If Courier Service partners do not pick up the shipment within 48 hours
      2. If Courier Service Partners refuse to pick up the shipment
      3. If customer’s request for reschedule of pick up exceeds 2 times
      4. If the customer has placed an order by mistake, on a case to case basis and before the courier service partner has confirmed pick up

    2. Coreyo’s decision on refund shall be at our sole discretion and shall be final and binding.
    3. All refund requests have to be raised within 5 days from the date of transaction and refund amounts shall be credited to the customer’s bank account within 5-7 working days in accordance with terms that may be stipulated by the bank which has issued the credit/debit card.

K. Disclaimer

  1. You agree, understand and acknowledge that Coreyo is an online platform that enables You to select desired Courier Partner and avail its Services at the price indicated therein at any time from any location. You further agree and acknowledge that We are only a facilitator and is not and cannot be a party to or control in any manner any transactions on Coreyo. Accordingly, the contract shall be a strictly bipartite contract between You and the Courier Partner. Coreyo shall have no liability whatsoever, to fulfil the transaction in case the Courtier Partner fails or denies to provide the services. The user hereby agrees that it shall not and cannot seek specific performance from Coreyo for the service denied/failed by the Courier Partner.
  2. Coreyo’s Services (including but not limited to software), included on or otherwise made available to You through Coreyo are provided on “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, We does not warrant that:
    1. Coreyo will be uninterrupted, timely, secure or error-free; or
    2. The information on this Coreyo is complete, true, accurate or non-misleading; or
    3. The ratings that may be obtained from use of Coreyo will always be accurate or reliable; or
    4. The quality of any products, services, information, or other material purchased or obtained by You through the Service will meet Your expectations, or that any errors in the Service will be corrected.
  3. You acknowledge and undertake that You are accessing the Services on Coreyo and transacting at Your own risk and are using Your best and prudent judgment before entering into any transactions through Coreyo. We shall neither be liable nor responsible for any actions or inactions of Courier Partners nor any breach of conditions, representations or warranties by the Courier Partners of its Services and hereby expressly disclaim and any all responsibility and liability in that regard.
  4. All commercial/contractual terms are offered by and agreed to between Users and Courier Partners alone. The commercial/contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to Booking. We do not have any control or do not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Users and Courier Partners. You agree to not hold Coreyo liable in any manner in a dispute between you and the Courier Partner and agree to keep Coreyo indemnified in a dispute between you and the Courier Partner.
  5. Placement of Booking by a User with Courier Partner on the Coreyo platform is an offer to avail the services of Courier Partner and it shall not be construed as Courier Partner’s acceptance of User’s offer to provide the requested Services. The Courier Partner retains the right to cancel any such Booking placed by the User, at its sole discretion and the User shall be intimated of the same by way of an email/SMS. Any transaction price paid by User in case of such cancellation by Courier Partner, shall be credited to the concerned User wallet.
  6. We do not make any representation or warranty as to specifics (such as quality, value, saleability, etc) of the Services listed on Coreyo. We do not implicitly or explicitly support or endorse purchase of any Services on Coreyo. We accept no liability for any errors or omissions, whether on behalf of itself or third parties.
  7. We are not responsible for any non-performance or breach of any contract entered into between Users and Courier Partners. We cannot and do not guarantee that the concerned Users and/or Courier Partners will perform any transaction concluded on Coreyo. We shall not and is not required to mediate or resolve any dispute or disagreement between Users and Courier Partners.
  8. We do not at any point of time during any transaction between User and Courier Partner on Coreyo come into or take possession of any of the Services offered by Courier Partner nor does it at any point gain title to or have any rights or claims over the Services offered by Courier Partner to User.
  9. You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the Courier Partner(s) that You transact with.
  10. At no time shall the Company hold any right, title or interest and/or have any obligations or liabilities in respect of such contract entered into between Users and Courier Partners. We are not responsible for unsatisfactory or delayed performance of Services or damages or delays.
  11. We reserve the right, but do not have the obligation, to monitor Coreyo and Your use thereto for violations of terms of this Terms of Use or any policies and manage Coreyo in a manner designed to protect our rights and property and to facilitate the proper functioning of Coreyo and/or Services offered therein.
  12. You acknowledge and undertake that You are accessing the Services on Coreyo and transacting at Your own risk and are using Your best and prudent judgment before entering into any transactions through Coreyo. We shall neither be liable nor responsible for any actions or inactions of Courier Partners nor any breach of conditions, representations or warranties by the Courier Partners of its Services and hereby expressly disclaim and any all responsibility and liability in that regard.

L. Imdemnity and Release

  1. You agree to defend, indemnify and hold Us, Our subsidiaries, and affiliates, and their respective directors, officers, employees, service providers, representatives and agents (collectively, the “Indemnitees”) harmless from and against, any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any party due to or arising out of Your use of Coreyo and/or Services, including, without limitation Your use in violation of this Terms of Use, privacy Policy and other Policies or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
  2. Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defence and control of any matter/dispute for which You are required to indemnify an Indemnitee, and You agree to cooperate, at Your expense, with Our defence of such claims/disputes. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification provision upon becoming aware of it.
  3. You hereby expressly release the Company and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of the Courier Partner and specifically waiver any claims or demands that You may have in this behalf under any statute, contract or otherwise.
  4. You understand, agree and acknowledge that Coreyo through its Courier Partners are a mere bailee of the consignment, cash and is not an insurer of the same. User hereby expressly and specifically waives all its rights and claims against Coreyo and its Courier Partners arising out of or in relation to the principles of insurance. If not insured through Coreyo, You hereby undertake and agree to insure the shipments from point of origin to point of final destination at Your own cost, risk and liabilities. In certain cases, the Courier Partner shall in its sole discretion, be at liberty to collect additional risk charges from You.

M. Limitation of Liability / No Liability

  1. To the maximum extent permitted by Applicable Law, the Company shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from Your access to or use of Coreyo or in connection with these Terms of Use and/or Services of any Courier Partner with whom You may contract, regardless of the purpose.
  2. In no event shall the aggregate liability of the Company exceed the actual amount received by the Company, if any, against the disputed transaction or Services giving rise to the claim or two thousand Indian rupees (INR 2000/-) whichever is lower. The limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise, and whether or not the Company have been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. If, despite the limitation above, Coreyo is found liable for any loss or damage which arises out of, or in any way connected with, any of the occurrences described herein, then the liability of Coreyo will in no event exceed, in the aggregate, Two Thousand Indian Rupees (INR 2000/-). The limitations of liability provided in these Terms survive the termination of your relationship with us.
  3. There can be exceptional circumstances where the Courier Partner may be unable to honour the confirmed Bookings due to various reasons like act of God, labour unrest, insolvency, a pandemic, an epidemic, business exigencies, government decisions, terrorist activity, any operational and technical issues, etc. or any other reason beyond the control of the Courier Partner (“Force Majeure Events”). In any such Force Majeure Events, the User agrees that the Company being merely a facilitator of the Services booked, cannot be held responsible and accountable for any such Force Majeure circumstance.
  4. We shall not be responsible or liable in any manner to the Users for any losses, damage, injuries or expenses incurred by the Users as a result of any action taken by Us, where the User has consented for the same.
  5. We assume no liability or responsibility for any unauthorized access to or use of Our secure servers and/or any and all personal information and/or financial information stored therein.
  6. We shall not be liable for any interruption or cessation of transmission to or from Our platforms and any bugs, viruses, trojan horses, or the like which may be transmitted to or through Coreyo.

N. Courier Partner Policies

  1. You are aware that the contract between You and the Courier Partner is a bipartite contract and understand that the Company is merely a facilitator and is not and cannot be a party to or control in any manner any contractual obligations between You and Courier Partner pertaining to availed Services of selected Courier Partner. Accordingly, You are hereby requested to carefully read the CP Policies of the respective Courier Partner relating to terms & conditions, limitation of liability, packaging, cancellation, refund, banned items, weight deviation etc., accessible at the following link – www.coreyo.com/termsofservices.List of dangerous goods and restricted items depends on the terms of use of the respective Courier Partner chosen by the User. Read such terms and conditions carefully before availing any service from Coreyo. By utilizing the services of Coreyo, you agree that you have read the terms and conditions of use of the respective courier partner from their website in addition to the information provided by Coreyo
    (You are required to select respective Courier Partner from the list of Courier Partners in the said link to read the respective policies of the Courier Partner. On clicking the link pertaining to the courier partner, You shall be redirected to the selected Courier Partner domain on Coreyo, which shall comprise policy details of the selected Courier Partners.)

You understand and acknowledge that by clicking or activating such links You will leave Our website/platform and go to the other website, and that We do not screen, review, approve, or otherwise endorse any content or information contained in these linked websites. We are not responsible for any third-party websites accessed through Coreyo or any third-party content posted on, available through or installed from Coreyo and/or Services offered therein, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the third-party websites or the third-party content. You acknowledge and agree that such website links is/are not under Our control. The provision of a link by Us is for reference only and does not imply any endorsement of the linked website or of those in control of it. Access to any such third-party website links by You is at Your sole risk, We neither assume or accept any responsibility or liability nor make any representations or warranties regarding Your use of the such linked website.
  3. We reserve the right at any time to time to modify or discontinue, the Service (or any part thereof) of Courier Partner with or without notice. We shall not be liable to You or to any third party for any modification, price change, suspension or discontinuance of the Service of the Courier Partner.

O. User Representations and Warranties

  1. You agree, undertake and confirm that Your use of Coreyo shall be strictly governed under the Applicable laws, and You shall not host, display, upload, modify, publish, transmit, update or share any information which:
    1. belongs to another person and to which You do not have any right to;
    2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
    3. infringes any patent, trademark, copyright or other proprietary rights or third party’s trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;
    4. violates any Applicable Law for the time being in force;
    5. Deceives or misleads the addressee/ Users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

License: Subject to Your compliance with these Terms, We grant You a limited, non-exclusive, non- sublicensable, revocable, non-transferable license to: (i) access and use the applications on Your personal device solely in connection with Your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for Your personal or business (excluding commercial use of the Services). Any rights not expressly granted herein are reserved by the Company.
  3. Contents posted on Coreyo: All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork (collectively, “Content”), is a third-party content and We have no control over such third party content as the Company merely an intermediary for the purposes of this Terms of Use.
    Except as expressly provided in these Terms of Use, no part of the Coreyo platform and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including mirroring) to any other computer, server, platform or other medium for publication or distribution or for any commercial enterprise, without Our express prior written consent.
  4. Unauthorised / illegal usage: It is possible that other Users (including unauthorized users or hackers) may post or transmit offensive or obscene materials on the Platform and that You may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about You due to Your use of the Platform, and that the recipient may use such information to harass or injure You. We do not approve of such unauthorized uses, but by using Coreyo, You acknowledge and agree that We are not responsible for the use of any personal information that You publicly disclose or share with others on the Platform. Please carefully select the type of information that You publicly disclose or share with others on Coreyo. You must not use any mechanism to view or show any fields (or other data entities) for collecting or transmitting Coreyo Data to third parties without explicit written permission from Us. You must have adequate protections in order to keep secure and prevent any spurious or malicious usage or access of Coreyo
  5. Banned Items: User shall agree that You will not book / handover to courier person any good which is banned, restricted, illegal, prohibited, stolen, infringing of any third party rights, hazardous or dangerous or in breach of any tax laws or contains any cash, jewellery (excluding artificial jewellery), gold, silver, diamond, platinum, precious metals, precious stones, currency, bullion, letters and financial and security instruments and Courier partner/Company shall not be liable for the delivery of any such products. Without prejudice to the generality of the aforesaid, an indicative list of the banned or prohibited products is mentioned in detail in respective policies of the Courier Partner in Clause 10 above. However, this clause can be superseded in certain circumstances by a special approval from Coreyo.
  6. In the event User hands over or provides the aforesaid products to the Courier Partner shall not be responsible and shall not be liable for any loss, damage, theft or misappropriation of such products even if service provider or delivery personnel has the knowledge of the same and even if such loss, damage, theft or misappropriation is caused due to any reason attributable to service provider or delivery personnel. User shall be fully responsible for any third-party damages caused due to transport of banned items.
  7. The Users agree that they have reviewed the Courier Partner guidelines and the current Terms of Use, not restricted to the reasonability of items being dispatched, bundling prerequisite, required documentation for shipments, non-deserting, and so forth for the source and delivery destination.

P. Courier Policies

  1. Privacy Policy: Please review our Privacy Policy (Refer link [www.coreyo.com/privacypolicy]), which also governs Your visit to Coreyo, to understand our practices. The personal information / data provided to Coreyo by You during the course of usage of Coreyo will be treated as strictly confidential and in accordance with the Privacy Policy and applicable laws and regulations. If You object to Your information being transferred or used, please do not use Coreyo.
  2. Intellectual property: Coreyo is controlled and operated by Us and the Services are provided by respective selected Courier Partner(s). All material on Coreyo, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Content or information available on Coreyo is solely for Your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such content or information in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so. Without the prior written consent of the owner, modification of the content or information, use of the content or information on any other platform or networked computer environment or use of the content or information for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited.

Q. Term and Termination

  1. This Terms of Use shall remain in full force and effect while You use Coreyo and/or Services. You may terminate Your use at any time, for any reason, by ceasing to use Coreyo and/or Services offered therein and/or notifying us by sending a cancellation request at support@coreyo.com.
  2. Upon such termination or discontinuance, Your right to access and use Coreyo and Services will terminate immediately. You will remain liable for all amounts due under Your account up to and including the date of termination, if any. You agree that We will have no liability to You for any costs, expenses, losses, damages, or liabilities relating to such termination.
  3. Any provisions of this Terms of Use that, in order to fulfil the purposes of such provisions, need to survive the termination or expiration of this Terms of Use, shall be deemed to survive for as long as necessary to fulfil such purposes. We reserve the right to modify or terminate the Service for any reason, without notice at any time.
  4. You agree that upon the termination of these Terms of Use, We may delete all information related to You with respect to the Services availed by You.
  5. Once temporarily suspended, indefinitely suspended or terminated, the User shall not continue to use the Services under the same account, a different account or re-register under a new account, unless explicitly permitted by Us.

Coreyo is only a marketplace for courier service providers and the Users and any grievance being raised before the Grievance Officer shall not be construed in any way to mean that We provide such Services herein. The courier service providers are not employees or agents of the Company and consequently We shall not be held liable for their actions or inactions. The Grievance redressal office shall merely co-ordinate with the Courier Partner and attempt to resolve the issue raised by the user. The grievance redressal office may within a reasonable time respond to the queries or issues raised by the user.

  4. Submissions and Feedback: You acknowledge and agree that all questions, comments, suggestions, ideas, feedback or other information regarding Coreyo and/or Services listed therein (“Submissions) provided by You to or via Us or Coreyo and/or Services are non-confidential and We (as well as any of our designee) shall be entitled to an unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to You.

  5. In the event of a complaint been filed against the User or dispute been raised in relation to the shipment(s) made by the User, the User hereby agrees, provides his consent and further authorizes Us to share his/her relevant details and documents (including but not limited to business/registered name(s), phone number(s), address(es), email-id(s), bank account details, KYC documents, etc.) with the concerned judicial authority, court, police, complainant, etc. (as the case may be).

S. Miscellaneous

  1. Severability: If any part of this Terms of Use is declared void, voidable, illegal, invalid or unenforceable under the Applicable Laws, such part shall be severed, and the remainder of the Terms of Use will continue be valid and enforceable.
  2. Applicable Law: Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Bangalore. User undertakes to / shall comply with all the Applicable Laws applicable to them respectively.
  3. Dispute Resolution: In the event of any dispute, controversy or claim arising out of or relating in any way to Services availed by You under this Terms of Use, including without limitation any dispute concerning the construction, validity, interpretation, enforceability or breach of this Terms of Use, then You shall notify Us and the Courier Partner in writing about the said dispute, controversy, or claim, and within thirty (30) days of such notice, We shall facilitate a meeting with the Courier Partner at our Online Resolution Platform in attempt to resolve the dispute in good faith.
  4. Online Arbitration: Should the dispute not be resolved with yourself and the Courier Partner/Us, You shall seek remedies exclusively through online arbitration which shall be conducted in accordance with the ADReS Now Rules of Arbitration (“ADReS Now Rules”) at the ADRESNOW Online Dispute Resolution Portal (https://www.adresnow.com/). The arbitration shall be conducted online by sole arbitrator appointed in terms the ADReS Now Rules. Irrespective of the location of the counterparty to this contract or the arbitrator, the seat of the arbitration shall be deemed to be Bangalore. You specifically waive Your right to approach any court with jurisdiction for interim or injunctive reliefs, unless with respect to a proceeding to enforce this arbitration agreement
  5. No Relationship: Nothing in this Terms of Use (or any of the arrangements contemplated herein) shall be deemed or construed by the parties hereto nor by any third party as creating the relationship of employer and employee, principal and agent or a partnership between the parties for any purpose or entitle to commit or bind each other in any manner.
  6. Electronic record: This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
